Not everyone is eligible to file bankruptcy under Chapter 7 because of income or a previous bankruptcy.
Chapter 13 can still offer those individuals relief from creditors and collection activities. Additionally, if you are behind on mortgage payments, HOA fees, a vehicle loan, or have tax debt, Chapter 13 allows you to protect your assets by paying those debts over a 3-5 year period. In a Chapter 7, you may be able to keep your home or car, but you have to become current on payments shortly after you file. Certain tax debts are not affected by a Chapter 7 filing.

In some circumstances, Chapter 13 is a better option because it provides more flexibility to protect assets by rolling late mortgage or HOA payments into the repayment plan, and under certain conditions, principal amounts owed on a home or vehicle can be reduced.
